1. Practice of Terms and Conditions

1.1. Read these Terms and Conditions carefully before using our Website www.casaeleonora-algarve.com
1.2. These Terms and Conditions apply to all services, products, agreements, and offers of Casa Eleonora.
1.3. Your access to and use of the Services of Casa Eleonora is based on your acceptance of, and compliance with, these Terms. These Terms apply to all visitors, users and others who access or use our services. If you don’t accept these, we cannot deliver our services.
1.4. An agreement between Casa Eleonora/FlowInNature and the customer is established by the acceptance of the offer of Casa Eleonora/FlowInNature by the customer.
1.5. These Terms and Conditions form part of the agreement between the Customer and Casa Eleonora. Portuguese law applies to this rental agreement. By transferring the requested deposit the Customer agrees with the conditions stated below.
1.6. The Customer cannot transfer its rights deferring from an agreement with Casa Eleonora to third parties without the prior consent of Casa Eleonora.
2.1. All prices are expressed in euros, incl. BTW, excl. tourist tax, sales tax, and other taxes that may apply. Any additional costs that may be added through online payment are not included in the prices and are for the Customer.
2.2. Prices shown on the Website of Casa Eleonora are customizable until acceptance by the Client. The exact price will be put on an invoice and needs to be accepted by the Client. This agreement commits the client.
2.3. Casa Eleonora reserves the right to change prices shown on the Website, providing clear communication to the customer.
2.4. Breakfast is included in the rates that are shown on the website. The room price includes normal use of electricity and water. Bed linen and household linen and regular cleaning costs are included. The rooms are regularly provided with clean towels and freshened up. We change the bedding once a week.
3.1. Customer can book one or multiple rooms via the internet, by our online booking calendar, email or by telephone.
3.2. The reservation will be confirmed by Casa Eleonora by email. Upon receipt of the confirmation, the Customer must transfer a deposit to the account of Casa Eleonora within 14 days. After transferring the first payment, the reservation is completed and binding. The confirmation and these conditions together form the rental agreement.
3.3. The minimum stay is 2 nights.
4.1. The Customer must pay a deposit of 30% of the total room price. This must be paid to Casa Eleonora within 14 days of the confirmation date unless otherwise stated. Customer will receive an information email upon booking.
4.2. If the down payment period is exceeded, Casa Eleonora reserves the right to consider the reservation to be dissolved and to release the accommodation for rental.
4.3. The final term of 70% must be paid at least 30 days before arrival at Casa Eleonora.
5.1. Cancellation must be done by sending an email with booking ID.
5.2. In case of cancellation the following rules apply:
– Up to 30 days before planned arrival date no fees will be charged. The deposit of 30% will be returned.
– 30 to 14 days before planned arrival date the deposit of 30% will not be returned.
– less than 14 before arrival or in case of a ‘no show’ the entire amount will be charged.
5.3. In case of payment needed because of cancellation, the amount that is due needs to be transferred within 14 days to the bank account of the owner.
5.4. If Casa Eleonora is forced by circumstances to cancel the already payed booking, Customer will be notified in writing. The amount already paid by Customer will be refunded. Customer has no more and no other right than the already paid amount.
6. Force Majeure
6.1. Casa Eleonora is not liable if a shortcoming is the result of force majeure. During the period in which there is force majeure, for example, due to public unrest, strikes, hostilities, natural disasters and other unexpected situations that have arisen without fault of the actions of Casa Eleonora, the obligations of Casa Eleonora are suspended until Casa Eleonora can comply with it.
6.2. From the moment that a force majeure situation has lasted at least 30 calendar days, both parties may dissolve the agreement in writing in whole or in part.
6.3. Casa Eleonora does not owe any (damage) compensation in a situation of force majeure, even if it has obtained any advantages as a result of the force majeure situation.
7. General House Rules
7.1. Check in from 15h00 until 19h00. Check out from 08h00 until 11h00. Deviations from this rule can be discussed on a case-by-case basis. A later arrival or an earlier departure does not entitle the Customer to a refund of the room price or part thereof.
7.2. There is no smoking allowed throughout the whole house and garden.
7.3. Parties or events, such as bachelor parties, are not allowed on the site.
7.4. Pets are not allowed on the site.
7.5. The Customer declares to use the accommodation in a neat manner and to leave it in a tidy state on departure. An extra cleaning fee of € 50 will be charged, if Customer fails to follow the house rules and to keep the house clean. Use of the outdoor kitchen and BBQ are at Customer’s own responsibility. Casa Eleonora is not reliable for accidents that happen due to recklessness of the Customer.
7.5. In the event of a violation of these General Terms and Conditions, violation of house rules, and improper behavior, the manager of Casa Eleonora may immediately deny and/or refuse access to Casa Eleonora without further notice and explanation of reasons and without reimbursement of accommodation costs.
7.6. Noise, in particular between 10 p.m. and 7 p.m. and all day Sunday must be prevented.
7.7. Radios and other sound sources must not cause any nuisance to others.
8.1.During the rental period, the Customer takes care of the rented room and is liable for any damage caused during the stay. Any damage caused by the actions of the Customer should be paid in full compensation. Damages must be reported directly to Casa Eleonora by the Customer. Not reported damage will also be recovered from the Customer.
8.2. The Customer is not allowed to invite more people in the accommodation and/or to let them stay overnight than the number stated on the booking confirmation unless expressly agreed otherwise with Casa Eleonora.
8.3. Casa Eleonora is not liable for defects of technical installations and equipment. Repair or replacement does not entitle the Customer to a refund of (a part of) the room price. Casa Eleonora will ensure that repairs or replacement are carried out as quickly as possible.
8.3. Casa Eleonora can not be held liable for personal injury or damage, theft or loss of property of the Customer. Casa Eleonora is also not liable for any damage that the Customer and/or his travel companions suffer due to any cause related to the accommodation. Casa Eleonora will not be liable for compensation for any damage.
8.4.The property does not accept liability for:
– theft, loss or damage, of whatever nature, during or as a result of a stay at Casa Eleonora.
– disabling or decommissioning of technical equipment and the failure or closure of facilities at Casa Eleonora. This also applies to the consequences of external weather influences or other forms of force majeure. Unless there is gross negligence or intent on the part of Casa Eleonora.
8.5. All risks related to a stay in Casa Eleonora are borne by the users.
9. Limitation of liability
9.1. Casa Eleonora is only liable for damage the Customer suffers if this damage is a direct result of conscious recklessness of Casa Eleonora. Casa Eleonora is in no case responsible for errors that are due to insufficient or wrong input from the Casa Eleonora.
9.2. Casa Eleonora is not liable for damage if the Customer is insured or reasonably could have insured themselves against this damage.
10. Intellectual Property
10.1. Without explicit written permission from Casa Eleonora, it is not permitted to use text, photography, articles, blog posts, drawings, videos or other materials on the Website. The intellectual property belongs to Casa Eleonora.
11. Links to third-party websites
11.2. Casa Eleonora strongly advises you to read through the Legal document of third parties.
12. Use of Personal Data
12.1. Casa Eleonora collects the personal contact details of the Client to communicate, perform their services correctly and for legal reasons (such as taxes). Under no circumstances will Casa Eleonora transfer this information to third parties.
12.2.If the Client wishes to do so, it’s possible for them to view and/or improve this data or request to have their personal data deleted.
12.3.It is the Client’s responsibility to keep Casa Eleonora informed of any changes to their personal data.
12.4.The Client’s data is safely stored.
13. Governing Law
13.1.These Terms shall be governed by and interpreted and enforced under Portuguese law.
14.1. If these Terms change, you will find the most recent version here. If there are any changes, Casa Eleonora will provide at least 30 days’ notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Website and the Service.
